Welcome to Local Theory. These Terms of Service (“Terms”) govern your use of the website at localtheorymusic.com and the services offered there, including the Studio version-voting experience (together, the “Service”). The Service is operated by Unrivaled Marketing Solutions LLC, under the Local Theory brand (“Local Theory,” “we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who may use the Service
You must be at least 13 years old to use the Service, and at least the age of majority in your jurisdiction to enter into a binding agreement. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.
2. What the Service is
Local Theory is a music project. Through the Studio, listeners can become “producers” by listening to alternate takes of a song and voting on which version should make the final record. Participation in the Studio is currently free. We may add, change, or remove features of the Service at any time.
3. About the recordings
For transparency: Local Theory recordings feature a synthetic, AI-generated performing voice presented under the name Mason Creek. The songs, the direction, and the creative choices are the project’s own; the vocal performance is generated. We disclose this here because it is accurate and because you have a right to know what you are listening to.
4. Your account and sign-in
The Studio uses a passwordless, one-time-code sign-in sent to your email address. You are responsible for the email account you use to sign in and for any activity that occurs under your access. Do not share your sign-in codes. If you believe your access has been used without your permission, contact us at the address in Section 12.
5. Voting and fair participation
The Studio is meant to reflect the honest preferences of real people. You agree not to:
- cast votes through automated means, scripts, or bots;
- create multiple identities to vote more than once on the same choice;
- attempt to manipulate, inflate, or distort voting results; or
- interfere with the operation, security, or integrity of the Service.
We may disregard votes, restrict access, or remove content that we reasonably believe violates these rules. Voting results are advisory to the project; final creative decisions rest with Local Theory.
6. Acceptable use
You agree not to use the Service to: violate any law; infringe anyone’s rights; upload or transmit anything harmful, unlawful, or malicious; attempt to gain unauthorized access to any system or data; or scrape, copy, or redistribute the Service or its content except as expressly permitted.
7. Intellectual property
The music, recordings, artwork, text, logos, and other content on the Service are owned by Local Theory or its licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and enjoy the Service for your own personal, non-commercial use. Nothing in these Terms transfers ownership of any content to you.
Any feedback, votes, or suggestions you provide may be used by us without obligation or compensation to you.
8. Third-party services and links
The Service relies on third-party providers (for example, for email delivery, hosting, and data storage) and may link to third-party sites. We are not responsible for the content or practices of third parties. Your use of a third-party service is governed by that party’s own terms and privacy policy.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the fullest extent permitted by law, Local Theory and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars (US $100).
11. Changes, suspension, and termination
We may modify these Terms at any time. When we do, we will update the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the revised Terms. We may suspend or discontinue the Service, or your access to it, at any time.
12. Governing law and contact
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
